| Andrea Yates found not guilty in kids' deaths ![]() Texas mother Andrea Yates was found not guilty by reason of insanity on Wednesday in her second trial for drowning her five young children in a bathtub in 2001. The verdict was a sharp reversal of the one in Yates' 2002 trial when a different jury convicted her of capital murder and sentenced her to life in prison. Yates, 42, will not go free because of Wednesday's verdict, but will be sent to a state mental hospital for treatment. She will remain there until state District Judge Belinda Hill decides she is sane and safe enough to be released, a process that could take years. Yates, who is being treated with anti-psychotic drugs, looked stunned and tears welled in her eyes when the verdict was read. She hugged defense attorney George Parnham, who also defended her in the first trial, before she was led away by a court bailiff. | |||

She has a bad case of PTSD.I think the husband should be punished as well. He knew by there 3rd child that she had a bad case of PTSD when she last got checked by the doctor and she had a few psyciatric issues as well. And things were done but not enough was done. On top of that she never had any time for herself she was with those kids 24/7 and home schooled them as well as taking care of them. The now ex-husband divorced her, has gotten remarried already (less than a years time from the issue at hand and the divorce) and got a new car, etc. I am wondering did he morn at all?! He sure did jump ship fast. In any case she does have issues psycological ones and those need to be resolved first before she even get sentenced for jail time because just throwing her in jail will do no good if shes unstable mentally.

We all know that Rusty knew about it he is guilty as well, what kind of person can move on so quickly with thier life remarry and everything just like that. I think the whole case was messed up.

Uhh...they already do this. Many try to "plead insanity" in court to get out of things or lessen the charges. However in her case she really does have a problem. And you can throw a person in jail all you want to but if they really do have an issue it could do more harm than good. Getting her help first and having her truely understand whats going on and what she did and then putting her in prison/jail without parole would be the best venue for HER condition. The one thing for Yates is that she won't be sitting at home in comfort shes going to a facility thats not in Houston. It's somewhere in TX. She will be confined to that facility like a jail, getting treated. Quote:
FACT: It's more exspensive and wastes more of our tax dollars to sentence a person to death/death penalty than giving a person a sentence of life in jail without parole.
