| I dont see how this is a valid case to even argue. He used binoculars not his naked eye. Thats just like that woman that was complaining about the nude beach in Austin complaining you could see the people and it was a distraction...however she was viewing them by standing on the roof of her truck and using binoculars to view the people on the beach. They threw her cause out of court immediately. What a waste of time.
